TERMS AND CONDITIONS FOR KINGS WEDDINGS FILM AND PHOTOGRAPHY SERVICES

This Agreement (hereinafter “Agreement”) constitutes a binding contract for videography/photography services and/or products. By signing this Agreement, the Clients whose details appear on page 1 of this Agreement (hereinafter collectively referred to as “Clients”) agree to pay KingsWeddings Film and Photography (hereinafter “KingsWeddings”) for the services and/or products provided by KingsWeddings at the price set out on the front page of this Agreement.

The following are essential terms and conditions that apply to this Agreement:

1. Description of Services:

On the nominated date specified on the front page of this contract, KingsWeddings will provide to the client the following services (collectively the “video/photo production”). KingsWeddings agrees to digitally record, on DVD or other agreed formats, the client’s event as described on the front page of the contract. KingsWeddings will edit and mix the recorded video to produce a master video production, with quality and form at the sole discretion of KingsWeddings’ editor.

2. Exclusivity:

KingsWeddings shall be the only videography/photography service provider retained by the client for the event identified. Family and friends of the client may videotape/photograph the event for non-commercial purposes, provided that such persons do not interfere with the videographer’s/photographer’s duties. If, in the reasonable opinion of the assigned videographer/photographer, such persons are inhibiting their ability to perform their duties, the client will take all reasonable steps to prevent any further interference.

3. Videographer/Photographer:

KingsWeddings will assign a videographer/photographer from its staff exclusively for the client’s event. If necessary, additional assistance may attend the event. KingsWeddings reserves the right to change any initial assignment and substitute other staff videographers/photographers at any time.

4. Payment for Videography/Photography Services and/or Products:

A non-refundable deposit of $1000 is required at the time of booking in exchange for the services and/or products provided by KingsWeddings. Payments are to be made in accordance with the contract agreement with the client and the due dates specified therein.

Due to the booking being priced as a package, cancelling part of the package inclusions is considered as a cancellation of the whole package. Accordingly, the deposit is not refundable under any circumstances. If a client wishes to book only part of the initial package, a new contract will be required, and a new deposit must be paid for the requested services.

KingsWeddings reserves the right to withhold delivery of any work, video, and/or photography unless payments are made as agreed. A $500.00 per month surcharge will be applied to any outstanding balances not received by the due date. The final product will not be released or edited until final payment is received. Should any cheque fail to clear the account, the client will pay an additional fee of $500.00.

5. Illness and Unexpected Events:

KingsWeddings shall not be liable if performance or products are prevented or impaired due to war, industrial action, fire, acts of God including adverse weather conditions, shortages or unavailability of labour or materials, laws or governmental restrictions, or any other matter beyond reasonable control, including human error such as late arrivals, vehicle breakdowns, or equipment failures.

In the event of any unanticipated videographer or photographer illness, KingsWeddings will make all reasonable efforts to provide a competent substitute. If a substitute cannot be assigned in time for the event, KingsWeddings will promptly return all payments previously made, and will have no further liability. KingsWeddings reserves the right to decline outdoor videotaping or photographing in the event of inclement weather. The client is responsible for providing an alternate nearby location if required.

6. Liquidated Damages:

The client and KingsWeddings recognize that it is difficult to ascertain actual damages in the event of a breach by KingsWeddings. Accordingly, in cases of negligence or unintentional conduct resulting in damage to or loss of any video footage, photo images, or equipment failure, the client shall be entitled only to a percentage reduction of the price based on the actual recorded time or images lost or damaged.

7. Change in Date, Time, or Event:

  • More than 6 months from the event date: KingsWeddings will make reasonable efforts to accommodate date/time changes. If the new date conflicts with existing commitments, KingsWeddings reserves the right to terminate the Agreement, with forfeiture of any non-refundable deposits.

  • Less than 6 months from the event date: KingsWeddings will make reasonable efforts to accommodate the change. If the new date conflicts with existing commitments, KingsWeddings may terminate the Agreement. The client will forfeit and be responsible for the full contract amount.

If the client wishes to change a weekday wedding to a weekend, KingsWeddings reserves the right to adjust the package price based on the new date. If the client does not agree to the new price, KingsWeddings may cancel the booking, and the deposit is non-refundable.

8. Editing and Completion of Final Product:

Clients may submit in writing (by email) specific spelling mistakes or scenes to delete from the video. Editing of raw footage is at the sole discretion of KingsWeddings’ editors.

Failure to provide materials or payment within six (6) months allows KingsWeddings to:
a. Apply a 15% liquidated damages fee and additional cost for items made.
b. Cancel the contract completely with no refund if the balance remains unpaid.
c. Impose additional fees for any re-editing requested after delivery.

9. General:

This Agreement is governed by the laws of New South Wales. Any court action relating to this Agreement will be brought in a court of competent jurisdiction in New South Wales. If any provision is found invalid or unenforceable, it shall be severed, and the remainder shall remain valid. This Agreement is binding upon the parties, their heirs, executors, and assigns.

10. Publicity Rights / Promotional Use / Privacy:

By initialing, the client agrees that KingsWeddings may use images from the client’s event for commercial purposes, including promotional material. Videos and photos will not be released to third parties without written consent, except when legally required by court or government order.

11. Guarantees:

KingsWeddings will make every effort to properly record and photograph all pertinent footage and images. Due to the nature of live production, adverse situations, equipment failures, or hardware malfunctions may occur. KingsWeddings cannot guarantee that any specific portion of the event will be recorded or photographed in full, and shall not be held liable for failure to capture any portion of the event.

12. Changes to the Contract:

This Agreement constitutes the sole and exclusive agreement regarding services/products. No prior agreements, representations, or promises outside this document are valid. Any amendments must be in writing and signed by both parties.

13. Usage of Drone Filming or Photography:

Drone usage will comply with NSW state and aviation laws. Its operation is subject to legal, safety, and weather conditions, including wind speeds above 20 km/h or rain. The drone operator’s decisions are final, legal, and safe. KingsWeddings does not encourage violation of laws to satisfy client requests.

14. Post-Event Communications:

All post-event concerns must be submitted by email to info@kingsweddings.com.au. Meetings or phone conversations post-event are not permitted. KingsWeddings will respond within 3–4 business days after reviewing the concerns and consulting relevant staff.

15. COVID-19 Lockdown:

In case of a COVID-19 lockdown, KingsWeddings will reschedule the wedding at no extra charge, retaining the same contract, package, inclusions, and deposit. The client must provide FOUR alternative dates. If KingsWeddings cannot accommodate the proposed dates, the deposit will be refunded. If only one date is provided and KingsWeddings is unavailable, the deposit will be forfeited as a cancellation.
